1. Agreement

These Terms are a contract between you (and any organisation you represent) and MetaBinary Limited, a company registered in Ireland (CRO 806119, VAT IE4698974FH), Office 40 — Boxworks, 40–44 Patrick Street, Waterford, X91 X3KF, Ireland (“Partimation”, “we”). By creating an account or using the service you agree to them. If you do not agree, do not use the service.

2. The service

Partimation is a web application that analyses casting geometry, recommends manufacturing processes, generates rigging, runs reduced-physics simulation, and estimates cost. CastDFM is a subset offering the design-analysis features without quoting. Features vary by plan.

3. Advisory nature — important

Partimation provides decision support based on geometric heuristics and reduced-physics models. Its findings, recommendations, quotes, and simulations are estimates, not guarantees. Each result names the rule that produced it so you can judge it. You are responsible for verifying every output against your own engineering judgement, your foundry’s practice, and applicable standards before relying on it — for example before cutting a pattern or tool, committing a pour, or quoting a customer. Partimation is not a substitute for qualified engineering review and does not certify manufacturability, safety, or cost.

4. Accounts

You must provide accurate details, keep your credentials secure, and are responsible for activity under your account. You must be able to form a binding contract to use the service.

5. Plans, billing & cancellation

Paid plans are billed in advance on a recurring basis through Stripe. Prices are shown before you subscribe and may be in USD, EUR or GBP depending on your region. Taxes may be added where applicable. You can cancel at any time; cancellation stops future renewals and takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable. The service is offered to businesses: by subscribing you confirm you are acting in the course of a trade, business, craft or profession (a sole trader subscribing for business purposes is a business customer). If, exceptionally, you subscribe as a consumer, you have a 14-day right of withdrawal under EU law; by requesting immediate access to the service you consent to performance beginning at once and acknowledge the withdrawal right is lost once the service is fully performed. A free plan is available to evaluate the service before paying; paid plans have no separate trial period. We may change prices with notice; changes apply from your next renewal.

6. Your content & our intellectual property

You keep all rights to the files and data you upload (“Your Content”). You grant us a limited licence to process Your Content solely to provide the service to you, as described in the App Privacy Policy. We and our licensors own the software, models, and all Partimation and CastDFM intellectual property; nothing here transfers it to you. You may not copy, resell, reverse-engineer, or create derivative works from the service except as the law expressly permits.

7. Acceptable use & export control

You agree to the Acceptable Use Policy. You are responsible for compliance with export-control and sanctions laws for the parts and data you process (some castings and their data may be controlled — for example under ITAR/EAR or EU dual-use rules). Do not upload controlled technical data to the hosted service unless you are permitted to; on-prem is available for restricted work.

8. Disclaimer of warranties

To the fullest extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that results will be accurate, complete, or suitable for manufacturing. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including certain consumer rights.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, scrap, rework, tooling cost, production loss, or business interruption, arising from your use of or reliance on the service. Our total aggregate liability for any claim is limited to the amount you paid us for the service in the 12 months before the event giving rise to the claim. 10. Suspension & termination

You may stop using the service at any time. We may suspend or terminate access for breach of these Terms, non-payment, or to comply with law, with notice where practicable. On termination your right to use the service ends; export your data first (see the App Privacy Policy).

11. Governing law

These Terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction, without prejudice to mandatory consumer protections in your country of residence.

12. Changes

We may update these Terms; material changes will be notified in-app or by email and take effect on the date stated. Continued use means acceptance.
